DMCA Policy

Humble Echo LLC respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA) and other applicable laws. This policy explains how to report alleged copyright infringement on this website and any features, applications, or content we control (the “Services”), and how to submit a counter-notification. This policy works alongside the Terms of Service, Content Removal Policy, and Complaint Policy.

1. Reporting Copyright Infringement (DMCA Notice)

To request removal or disabling of allegedly infringing material on the Services, send a written notice that includes all of the following:

  1. your physical or electronic signature;
  2. identification of the copyrighted work you claim has been infringed (or a representative list if multiple works);
  3. identification of the material you claim is infringing (or the subject of infringing activity) and information reasonably sufficient for us to locate it on the Services (for example, URL, screen name, conversation or message ID, and timestamp);
  4. your name, mailing address, telephone number, and email address;
  5. a statement that you have a good-faith belief the disputed use is not authorized by the copyright owner, its agent, or the law; and
  6. a statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on the owner’s behalf.

2. Our Response to Notices

Upon receiving a complete DMCA notice, we will review it and, in our discretion, remove or disable access to the identified material within a reasonable time. Where feasible, we will notify the affected user and may forward your notice to that user. We may also document and retain removal actions consistent with our Privacy Policy.

3. Counter-Notification (If Your Material Was Removed)

If you believe your material was removed or disabled by mistake or misidentification, send a written counter-notification that includes:

  1. your physical or electronic signature;
  2. identification of the material that was removed or disabled and the location where it appeared before removal (for example, URL, conversation or message ID, and timestamp);
  3. your name, mailing address, telephone number, and email address;
  4. a statement, under penalty of perjury, that you have a good-faith belief the material was removed or disabled due to mistake or misidentification; and
  5. a statement that you consent to the jurisdiction of the Federal District Court for your judicial district (or, if outside the United States, any judicial district where Humble Echo LLC may be found) and that you will accept service of process from the person who filed the original notice or that person’s agent.

Unless the original claimant files an action seeking a court order, we may restore the material in a reasonable time after receiving a valid counter-notification.

4. Repeat Infringers

In appropriate circumstances, we may terminate accounts of users who are repeat infringers. We also reserve the right to remove content and impose restrictions where we reasonably believe infringement has occurred.

5. Misrepresentations

Under 17 U.S.C. § 512(f), any person who knowingly makes material misrepresentations in a DMCA notice or counter-notification may be liable for damages, including costs and attorneys’ fees.

6. Changes to This Policy

We may update this policy from time to time. The “Last updated” date shows when changes took effect. Where appropriate, material changes may be announced in the Services or by email.
