Welcome. These Terms of Service set out the rules and conditions for using this website, our checkout pages, and any features, applications, or content we control (collectively, the “Services”).
By accessing or using the Services, you agree to be bound by these Terms and by our Privacy Policy, Underage Policy, Blocked Content Policy, Content Removal Policy, DMCA Policy, and Complaint Policy, and other policies we publish or reference from time to time (collectively, the “Policies”). If you don’t agree to these terms, you may choose not to use the Services.
The Services are intended only for adults (18+). If you are under 18 (or the age of majority where higher), you must not use the Services.
The Services are offered by Humble Echo LLC, a company incorporated in the United States, with its principal business address at 30 N Gould St Ste R, Sheridan, Wyoming 82801, USA (“Company,” “we,” “us,” “our”). These Terms apply to your use of this website and Services we control, wherever accessed.
1. Changes to These Terms
We may update these Terms and the Policies from time to time. If we make material changes, we will provide notice (e.g., posted notice in the Services or email where appropriate). The “Last updated” date shows when changes took effect. Your continued use after the effective date constitutes acceptance.
2. Eligibility & Age Requirements
You must be 18 years or older (or the age of majority in your jurisdiction, if higher). We may suspend or terminate access if we suspect underage use or misrepresentation. If we reasonably believe an account is under 18 or age was misrepresented, we will remove the account immediately and may impose a permanent ban.
3. Accounts, Security & Electronic Communications
Provide accurate, current information and keep it updated. You’re responsible for activity under your account and for safeguarding credentials. One account per individual; no account sharing.
You consent to receive required communications electronically (e.g., email, in-product messages, posted notices). Electronic communications have the same legal effect as paper notices. Keep your contact info current.
4. Definitions
- “AI Outputs”: content generated by or through our models or tooling (e.g., text, images, audio).
- “User Content”: content you submit, upload, or provide (e.g., prompts, inputs, images, feedback).
- “Credits/Tokens”: prepaid, non-cash units used to access certain features.
- “Subscription”: a recurring paid plan granting access for a period.
- “Payment Provider/Processor”: third parties that process your payments.
5. Nature of the Services & Use of AI
The Services provide AI-enabled features that may generate fictional or synthetic outputs. AI Outputs may be inaccurate, incomplete, inappropriate, or otherwise unreliable. You use the Services and any AI Outputs at your own risk and must comply with these Terms and applicable law.
All Services are delivered digitally. Upon successful payment, your account is activated and immediate access to purchased features is granted through your user dashboard. No physical goods are shipped. A purchase confirmation is provided electronically.
6. License to Use the Services
Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable, limited license to access and use the Services for non-commercial purposes. We may change, suspend, or discontinue any part of the Services at any time without liability. Except as required by law, we have no obligation to provide support beyond what is described on our Support page.
All intellectual property in the Services (software, models, UI/UX, trademarks, and content excluding your User Content) is owned by us or our licensors. We reserve all rights not expressly granted.
7. Your Content & License to the Company
You retain rights in your lawful User Content. You grant us a worldwide, non-exclusive, sublicensable, transferable, royalty-free license to host, store, reproduce, process, adapt, translate, modify, publish, distribute, display, and use your User Content to: (i) operate and provide the Services; (ii) enforce safety and moderation; (iii) comply with law and legal process; and (iv) maintain and improve the Services, including model and system performance. We may use de-identified and aggregated User Content to train and evaluate models and safety systems.
You must not submit or attempt to generate content depicting real persons (including celebrities or public figures) without verifiable, written consent. Do not upload personal data of third parties without authorization.
8. Prohibited Content & Activities
You must not submit, generate, request, promote, or share content that is illegal, harmful, or violates these standards.
8.1 Absolute bans
- Any sexual content involving minors (real or implied) or the sexualization of anyone under 18.
- Sexual content involving animals or non-human species.
- Sexual violence or exploitation, including non-consensual acts.
- Sexual content targeting vulnerable individuals (e.g., unconscious or incapacitated persons, or sexualization of disability).

8.2 Additional prohibited categories
Harassment, hate/extremist content, doxxing, self-harm promotion, illegal activity or instructions, IP infringement, fraud/phishing/malware, unauthorized scraping, attempts to bypass safety systems, spam or deceptive schemes.

9. Safety Controls, Keyword Blocking, Moderation & Reporting
We use automated safety systems (including keyword/phrase and classifier-based filters) and human moderation. We may expand or change these controls without notice. Implementation details and examples will be provided in our Blocked Content Policy.
We may warn, remove content, limit features, suspend, or terminate accounts. We may log prompts, outputs, timestamps, and technical data for safety, fraud prevention, and compliance.
We maintain a zero-tolerance policy for CSAM and report known CSAM to the National Center for Missing and Exploited Children (NCMEC) or competent local authorities.
10. Payments, Subscriptions & Credits/Tokens
Prices, taxes, and fees are shown at purchase and may change as displayed on our Pricing & Plans page and at checkout. Unless otherwise stated at checkout, all prices are shown and charged in USD. Some payment methods are handled by Payment Providers; their terms apply.
Payments are processed by PCI-DSS compliant third-party payment processors over HTTPS. We do not store full payment card numbers; payment information is handled securely by our processors.
Subscriptions renew automatically at the then-current rate unless you cancel before renewal via your account settings. After cancellation, access continues until the end of the current period unless otherwise stated at purchase.
Credits/Tokens are not currency, have no cash value, are non-transferable, and are non-redeemable for cash, except where required by law. Credits/Tokens currently do not expire. We may introduce expiration for future purchases with prior notice (this would not affect existing balances unless required by law).
From time to time, we may offer promotional pricing, trial periods, or discounts. The specific terms of any promotion will be disclosed at signup or checkout. We may modify or withdraw promotions at any time in accordance with applicable laws.
If you initiate a chargeback or payment dispute, we may suspend your account pending investigation and recover associated fees and costs as permitted by law.
11. Refunds & Cancellations
Refund window. Refund requests must be submitted within 7 days of the original charge and are available only for technical faults preventing reasonable use (not caused by your device, network, or misuse) or for billing errors (e.g., duplicate charge, incorrect amount).
Exclusions. No refunds for used or substantially consumed subscriptions or Credits/Tokens (e.g., messages sent, images generated), dissatisfaction with subjective quality where features functioned as intended, violations of these Terms, fraud, or payment methods typically non-refundable (e.g., certain cryptocurrencies or third-party vouchers) except where required by law.
Process. Contact us (see Section 22, Contact) with your account email, transaction ID, date, method, and description. We may request logs/evidence and attempt to diagnose/remedy first. If eligible, we will refund or credit your account (at our discretion) or, where processed by a Payment Provider, escalate an approved refund to that provider.
EU/UK consumers. Mandatory statutory rights (including the 14-day withdrawal right for digital content) apply unless you expressly consent at checkout to immediate performance and acknowledge loss of the withdrawal right.
12. Dispute Process (Pre-Chargeback)
Before initiating any formal dispute or chargeback, you must contact us (see Section 22, Contact) and allow a reasonable opportunity (e.g., 10 business days) for us to resolve the issue. We may rely on usage logs, timestamps, and system diagnostics as evidence. Abuse of disputes or excessive chargebacks may result in account termination.
13. Third-Party Services
The Services may rely on or link to third-party services (e.g., hosting, analytics, moderation, payment). We are not responsible for their availability, content, or actions. Your use of third-party services is governed by their terms.
14. Intellectual Property; Content Removal & Notice
Our names, logos, product names, and UI are trademarks of the Company or licensors. You may not use them without permission.
If you believe content infringes your rights, follow our Content Removal Policy and DMCA Policy for sending an effective notice and understanding our repeat-infringer policy. We may remove content and terminate accounts where appropriate.
15. Disclaimers
The Services (including AI Outputs) are provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties—express, implied, or statutory—including merchantability, fitness for a particular purpose, title, and non-infringement. We do not guarantee accuracy, reliability, availability, or that the Services will be error-free or secure.
16. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business interruption, even if advised of the possibility. Our total liability for all claims relating to the Services shall not exceed the amount you paid for the service at issue in the 12 months before the event giving rise to liability. Some jurisdictions do not allow certain limitations; in such cases, our liability is limited to the maximum extent permitted.
17. Indemnification
You agree to defend, indemnify, and hold harmless the Company and its affiliates, officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (i) your User Content; (ii) your use of the Services; (iii) your violation of these Terms or applicable law; or (iv) your infringement or misappropriation of third-party rights.
18. Suspension & Termination
We may suspend or terminate your account or access at any time, with or without notice, if we believe you violated these Terms, pose a risk to others, or for operational/security reasons. Upon termination, your license ends and you must stop using the Services. Sections that by their nature should survive (including Sections 5–8 and 10–21) survive termination.
19. Governing Law & Dispute Resolution
To provide predictable forums while recognizing global use:
- US users. These Terms are governed by the laws of the State of Wyoming, excluding its conflicts-of-law rules. Disputes will be handled in Wyoming using individual, non-class procedures.
- Non-US users. These Terms are governed by the laws of Singapore, subject to any mandatory local consumer protections. Disputes may be handled in Singapore using individual, non-class procedures.
Either party may seek temporary or injunctive relief in a court of competent jurisdiction to protect intellectual property or confidential information.
20. International Use & Compliance
You are responsible for complying with local laws. Access from territories where the Services are illegal is prohibited. You must comply with export controls and sanctions applicable to you.
21. Miscellaneous
- Entire agreement. These Terms and the Policies are the entire agreement between you and us regarding the Services.
- Severability. If any provision is invalid, the remainder remains in effect.
- No waiver. A failure to enforce is not a waiver.
- Assignment. You may not assign these Terms; we may assign to an affiliate or successor.
- Headings. For convenience only.
